What are your rights when a South Texas accident involves an illegal alien?

A 21-year-old man from Mexico was crushed under an 18-wheeler tractor trailer. The incident occurred on the morning of April 8, 2010 at the 1600 block of World Trade Center in Laredo. Police received a phone call at 9:30 am reporting the semi truck–pedestrian accident.

The truck driver was picking up a heavy load at the location. As he moved the level to distribute the weight of the trailer, he crushed the man underneath. When the driver saw blood on the pavement, he looked under the trailer and saw the man’s body. The man was pronounced dead at the scene.

The man is believed to be an illegal immigrant. No one knows why he was under the big rig or how he got there.

Many illegal immigrants believe that if they are involved in a car crash or truck accident that they should not make a police report, bring a claim, or go to the hospital because they may be deported. In fact, any person injured in an accident by a negligent party should seek compensation for their injuries and damages. There is absolutely no citizenship requirement for pursuing an accident claim. However, the only way to get insurance compensation is by waiting for a police officer to arrive at the accident scene and document the incident in a police report.
