If I am in a accident, what does the insurance company owe me?

 

A: Under Texas law, if the other driver was at fault, you are entitled to compensation for both property damage and for personal injuries.

If your car is damaged so badly that it is considered a total loss, then the insurance company owes you the fair market value of your vehicle.  If the car is not a total loss, then the insurance company owes you for the cost of repairing the vehicle, and also has to reimburse you for the loss of use of your vehicle while your car is being repaired.

If you are injured, the insurance company is also responsible to compensate you for medical bills, lost wages, physical pain, emotional suffering, disfigurement, and impairment.  However, there is a limit to how much can be paid under a particular policy.  The minimum amount for liability insurance in Texas is $25,000 per person up to a total of $50,000 for everyone involved in one accident.  However, some people and companies carry substantially more insurance.
